These General Terms and Conditions of Participation apply to all prize draws conducted on Eternal God's social media platforms (such as Instagram, TikTok, WhatsApp Business) or via the Eternal God website, and to which these conditions are referenced. Any additional conditions for individual prize draws (e.g., directly in the respective post) shall take precedence over these conditions.
1. Eligibility
Any natural person permanently residing in Germany, Austria, or Switzerland is eligible to participate. Persons who have not yet reached the age of 14 are excluded from participation. Persons with limited legal capacity who have reached the age of 14 are only eligible to participate, subject to legal provisions, if Eternal God GmbH permits this for the respective prize draw and the legal guardians effectively consent.
All employees of Eternal God GmbH and their relatives are not eligible to participate. Persons not eligible to participate do not acquire any right to a prize, even if a prize is awarded to them. Each participant may only participate in their own name. Prizes are not transferable to third parties.
2. Data Processing
When participating in the prize draw, some mandatory information and some voluntary information is requested (e.g., first name, last name, address, age, email address, and/or telephone number). All such personal data will be treated by us in accordance with our privacy policy and any additional consent declarations given. For participation in the prize draw, all information must be truthful. Otherwise, exclusion from the prize draw may occur.
3. Submission of Materials (Content)
If participation in a prize draw requires the submission or uploading of materials (e.g., photos, videos, texts), the following applies: The participant undertakes not to provide any criminal, discriminatory, youth-endangering, pornographic, racist, and/or otherwise extremist content and indemnifies us from third-party claims in this respect. Furthermore, each participant assures that they are the sole owner of all rights of use and exploitation of the submitted materials.
Each participant grants us the simple, transferable, sublicensable, and otherwise gratuitous right to use these materials without temporal, spatial, or content restrictions for the purpose of conducting the prize draw and reporting on it. Each participant also transfers ownership of the physically submitted materials to us, unless they expressly and in writing object to this before the winner is announced at the address provided in the imprint.
4. Liability and Right to Amend
Eternal God GmbH assumes no liability for technical malfunctions (e.g., network, computer, or connection errors) that are beyond its control and impair the submission of the entry. Eternal God GmbH is only liable for submitted materials in cases of intent or gross negligence.
Eternal God GmbH reserves the right, in the event of changes in legal regulations, jurisprudence, or due to an official/judicial prohibition, to replace the announced prizes with equivalent alternative prizes, to change the course of the game, or to cancel the prize draw entirely. In these cases, the participant or already determined winner has no claims against Eternal God GmbH.
5. Winner Determination and Notification
The winners will be determined by Eternal God GmbH or its agents. In the event of a win, the participant will be notified in text form (e.g., by email or direct message on social media platforms) or by telephone.
The winner is obliged to respond within the period specified in the prize draw (if no period is specified in the prize draw: within 7 days) after receiving the notification and to provide the required address data. If this is not done in due time, Eternal God GmbH is entitled to draw a new winner. Replacement claims of the initially drawn winner against Eternal God GmbH are excluded.
Non-cash prizes will not be paid out in cash. Any subsequent costs (e.g., travel expenses, allowances) that were not expressly advertised as part of the prize must be borne by the winner themselves.
6. Exclusion and Final Provisions
In case of violations of these conditions or the specific game rules, a participant may be excluded from participation at any time and without prior notice.
The legal process is excluded. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected. German law applies. If the participant is a fully qualified merchant, a legal entity under public law, or a special fund under public law, Cologne is agreed as the place of jurisdiction.
7. Social Media Disclaimer
This prize draw is not affiliated with Instagram, TikTok, Facebook, or WhatsApp and is in no way sponsored, endorsed, or organized by these platforms. The sole point of contact and responsible party is Eternal God GmbH.
